Today was a really great WOD for me. My arms, traps, biceps and generally the top half of my body was sore from Mondays 50 clean and jerks but I still managed to do this WOD as prescribed which doesn’t happen all that often. I love wods like this one though.

I am having some bad habits lately that are contributing to my inability to lose weight. I have a real issue with operating under severe sleep deficit. This is for several reasons, first, my kids wake me up during the night for water, or because of nightmares or whatever anywhere from 2am to 4am. It happens every single night. In itself this would be ok but paired with the fact that I am a night owl and often stay up until midnight, and then need to wake up at 5am for crossfit….well, I’m not at my best. My other bad habit is my dinners. My husband works awful hours and so when he misses dinner at home I tend to not want to cook for myself so I just either don’t eat dinner, or we eat out, or a graze, or a nibble dinner with my kids at 4pm and then snack in the evening. My protein intake is probably very low for the past several weeks and with my lack of proper sleep I am very low energy throughout the day and very cranky. I need to figure out how to go to sleep earlier, or nap and I need to put in more effort into food prep even if it is just for myself. I don’t think any diet I do will help me until I get these habits under control, especially during times of schedule chaos like I am in now.

Pot Meet Kettle: Lululemon Aggressively Pursues Patents and Borrows Designs

Earlier, I wrote a post about how Lululmon’s latest upload of mesh lab designs are almost identical replicas to another brand called Nesh NYC which already had their versions online before Lululemon uploaded them. A reader just sent me this article, Lululemon Patent Troll discussing Lululemon’s aggressive pursuits for patents on some of their designs Lululemon Patents, and litigation against brands with similar designs. As an avid customer of Lululemon, I am glad they are filing patents on their designs and IP partnerships on some of their more interesting materials (read this article here about a recent Kick Starter campaign using Lululemon’s Silverscent). It means I wont see a cheaper version of the item I have just purchased and it also means my items will sell well when I decide I want to upcycle them on ebay. It is unlikely that Lululemon will patent luon as a material as it is more commonly known and used as ‘supplex‘. For real, that is all it is.  With patents and IP’s my investment as a consumer is protected, and it pushes other brands as well as Lululemon to innovate rather than copy. I am rather annoyed to see some of the items Lululemon is putting out, for example the Nesh NYC inspired designs uploaded tonight, and Michi inspired from several weeks ago (tech mesh tights), are almost exact replicas. Nesh NYC is a much smaller and new start up company. Does this mean that because Nesh has not filed a patent that Lululemon now will? Why not just hire those talented designers? Perhaps Hanesbrands who is pushing back on Lululemon’s cease and desist letter by arguing that the No Limit Tank should never have been awarded patent will help fund some of these smaller brands in their litigation. All of this is quite unprecedented in the fashion industry and so I am very interested to see how this goes. As stated, on one hand I am pleased to see lululemon is fiercely protecting their designs and innovation, on the other, competition is the greatest motivator (or regulator).

Speed Shorts, sleeve cuffs/thumbholes, hoods with poney tail holes, their new towel mat, Keep on Running Duffel, Run: Inspire Jacket (do they intend to bring this one back??)

Lululemon Copying Nesh NYC Designs?

Now this is funny. They say copying is the sincerest form of flattery.  I recently signed up for affiliate links (the widget you sometimes see at the bottom of my posts – it’s a temporary try out) and one of the items that pop up for me to use is this Nesh NYC brand which I probably would not have come across otherwise. Today, Lululemon uploaded some ‘lab designs’ that are almost identical to Nesh NYC .

I tweeted Lululemon about not being able to see the upload (as I do each week) and if you had issues seeing with the upload crashing on you or not allowing you to view it, or only being accessible in french, make sure you tweet them so they are aware how wide spread the issue is #fixtheupload. I ordered off the french side (which I’ve had to do since November) and got the heathered grey Tuck And Flow LS. I am annoyed though that Opal and Cadet Blue didn’t upload since those were the ones I wanted. How bout those lab mesh items…..

I want to order this bang buster but the website has now crashed on me. 

 These Lab Mesh tights would be an interesting experiment to see what happens with thighs that touch

Apres Practice Cardigan out on Canadian side, not US. I’m surprised this came back. I quite liked it but last year I don’t think they sold that well. They did eventually sell out but they also got marked down.

No Tuck And Flow LS’s at my store today but they did get the Jewelled Magenta 105F Singlet. I think I’ll be returning the Great Granite CRB in favour of this and hope for a Great Granite Energy Bra that I can wear under this 105F.
